Who inherits the estate in Texas? Get the answer with a few clicks:
Find out who will receive any person’s intestate estate and how much of that estate each heir will receive.
The Texas Intestacy Evaluator℠ uses the Texas Probate Code to first determine the legal heirs or next of kin for any person’s intestate estate, then to determine the legal distribution of that estate among those heirs. This program determines the distribution of Texas intestate estates by considering:
~ Three types of property
~ The surviving spouse sharing with relations as distant as the issue of a deceased parent
~ The surviving spouse’s parental relationship with the deceased’s issue
~ Division in different amounts among whole and half blood relations
~ Split between the maternal and paternal relations at the grandparent level
~ Sharing between a surviving parent with the issue of the deceased parent
User provided data is evaluated by referencing the Texas Probate Code to examine each potential level of relation for a qualified heir through the last eligible level of relation before escheat.
Each user response is evaluated in comparison with the applicable intestate laws and all prior responses to determine the most relevant information that must be solicited next to determine the legal heirs of the current estate, as well as the dollar value that each heir is entitled to receive.
